Eligibility: The Elegant SMP Giveaway (the “Giveaway”) is open only to legal residents of the United States or Canada who are at least eighteen (18) years old at the time of entry. Employees of Elegant SMP and their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members and/or those living in the same household of each are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state, and local laws and regulations.
Entry Period: The entry period for the Giveaway will be stated in the Instagram post.
How to Enter: To enter, participants must follow the instructions outlined in the Instagram post. Eligible participants may enter once.
Prize: The prize for the Giveaway will be as stated in the Instagram post.
Winner Selection: The winner will be selected in a random drawing from all eligible entries received during the Giveaway Period. Odds of winning depend on the number of eligible entries received. The drawing will be conducted by Elegant SMP, whose decisions are final and binding.
Winner Notification: The winner will be notified via email, Facebook, Twitter, or Instagram within two (2) days following the winner selection. Elegant SMP shall have no liability for any winner notification that is lost, intercepted, or not received by the potential winner for any reason. If a potential winner does not respond within forty-eight (48) hours, he or she may be disqualified, and another winner may be selected at Elegant SMP’s sole discretion.
Prize Forfeiture: If the winner forfeits or does not claim the prize, the prize will be re-awarded, at Elegant SMP’s sole discretion. All federal, state and local taxes associated with the receipt or use of any prize are the sole responsibility of the winner.
General Conditions: By participating in the Giveaway, each participant agrees to abide by these Official Rules, which are final and binding in all respects. Elegant SMP reserves the right to disqualify any participant that it determines, in its sole discretion, violates these Official Rules.
Limitations of Liability: Elegant SMP is not responsible for: (1) any incorrect or inaccurate information, whether caused by participants or by any of the equipment or programming associated with or utilized in the Giveaway; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Giveaway; (4) technical or human error that may occur in the administration of the Giveaway or the processing of entries; or (5) any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from participation in the Giveaway or receipt or use or misuse of any prize. If for any reason a participant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the participant’s sole remedy is another entry in the Giveaway, provided that if it is not possible to award another entry due to discontinuance of the Giveaway, or any part of it, for any reason, Elegant SMP, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming, or any other reasons cause more than the stated number of prizes as set forth in the giveaway to be available and/or claimed, Elegant SMP reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
This contest is under the legal jurisdiction of the State of New York.
